Welcome to AirSync HVAC Inc. (“AirSync,” “we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your use of our website at airsynchvac.com and any related services, quotes, installations, and communications, including text messages and emails. By using our site or services, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the site or services.

1) Services, Quotes, and Scope

• We provide HVAC consultation, quotes, installation, and related services for residential and commercial properties.

• Quotes are estimates based on information available at the time and may change after site inspection, code requirements, or unforeseen conditions.

• Work scope is defined in the written proposal or service agreement you approve. Changes need written approval and may affect price and timing.

2) Scheduling, Access, and Site Conditions

• You agree to provide safe access during scheduled windows and to ensure utilities are available for testing and installation.

• If conditions prevent safe work or access, we may reschedule and charge a reasonable trip fee.

3) Pricing, Payment, and Refunds

• Prices are stated before work begins in your proposal or invoice. Taxes, permit fees, disposal fees, and specialized materials may be extra.

• Payment terms appear on your invoice. Late balances may accrue interest or late fees as permitted by law.

• Deposits are applied to the final balance and may be nonrefundable if materials have been ordered or custom work has begun.

4) Warranty and Disclaimers

• Manufacturer warranties apply to equipment as stated by the manufacturer. Any workmanship warranty is described in your proposal.

• Normal wear, improper use, lack of maintenance, or third-party alterations are not covered.

• Except as expressly stated, the site and services are provided “as is” and “as available.”

5) Your Responsibilities

• Provide accurate information in forms and calls.

• Follow care, maintenance, and filter replacement instructions.

• Keep pets and children away from the work area and secure valuables.

6) Text Messaging Program Terms (A2P compliant)

Program description: We send service-related texts about your HVAC quote, scheduling, appointment confirmations, ETA updates, and service follow ups when you request service through our website or by phone. We do not use third-party lead lists.

Opt-in methods:

• Submitting our web form and selecting an unchecked SMS consent box, or

• Texting a keyword to our number, or

• Providing verbal consent on a recorded line.
  We capture consent with timestamp, IP, page URL, form ID, and checkbox text where applicable. Consent is not a condition of purchase.

Message frequency: Conversation based. Frequency varies by request. We may send up to 3 follow ups if you are unresponsive.

Fees: Message and data rates may apply.

Opt-out: Reply STOP to end texts. You can also reply END, CANCEL, UNSUBSCRIBE, or QUIT. After a stop keyword, we send one final confirmation and then cease messaging unless you opt in again.

Data and privacy: We use your number only to deliver the messages described. We do not sell your data. See our Privacy Policy.

Eligibility and carriers: U.S. users only. You must be the owner or customary user of the mobile number you provide. Delivery is subject to carrier networks and device compatibility.

7) Email Communications

By submitting your email, you agree to receive service-related emails for quotes, scheduling, invoices, and support. You can unsubscribe from non-essential emails via the link in the footer.

8) Electronic Records and Signatures

You agree to receive electronic records and signatures related to your requests and service. Keep your contact details current so we can send scheduling and safety notices.

9) Intellectual Property

All site content, logos, text, graphics, and software are owned by AirSync or its licensors and are protected by law. You may not copy, sell, or exploit content without permission.

10) Acceptable Use

Do not misuse the site, attempt unauthorized access, or upload harmful code. We may suspend access for suspected abuse.

11) Third-Party Links and Tools

The site may link to third-party sites or tools. We are not responsible for their content, policies, or practices. Review their terms and privacy policies.

12) Disclaimer of Warranties

To the fullest extent permitted by law, we disclaim all warranties not expressly set out in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

13) Limitation of Liability

To the fullest extent permitted by law, AirSync and its officers, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, even if advised of the possibility. Our total liability for any claim related to the site or services will not exceed the amount you paid for the specific service giving rise to the claim.

14) Indemnification

You agree to indemnify and hold AirSync harmless from claims, damages, losses, and expenses arising from your misuse of the site or breach of these Terms.

15) Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York. Any dispute will be brought in the state or federal courts located in Bronx County, New York, and you consent to their jurisdiction and venue. Small claims court actions are permitted.

(If you prefer arbitration, say so and I’ll swap this to a JAMS/AAA clause with Bronx County venue.)

16) Changes to Terms

We may update these Terms at any time. The updated Terms will be posted with a new effective date. Your continued use after changes means you accept the updated Terms.
